As part of the APCCA webinar series, the SCCA brings insights into the COVID-19 pandemic in India.

India is one of the largest economies in the world and has always been among the top markets of interest for Singapore companies looking to expand overseas. Both countries as part of the ASEAN Free Trade Area, have a double tax agreement that helps increase trade and investment flows.

Speakers will address mainly how/what Governments and Authorities have had to implement new temporary measures including Decrees, Act and Regulations to put into effect policies, measures, restrictions, curfews, working from home directions, lockdown and/or circuit breaker – that are dramatically disrupting work and society functions while allowing social distancing and the pandemic to subside.

ABOUT APCCA

Asia Pacific Corporate Counsel Alliance (APCCA) in its original form was initiated in 2009 at the first regional corporate counsel conference (organised by SCCA in Singapore) with signatories being the SCCA, Indonesia Corporate Counsel Association (IndonesiaCCA), Association of Corporate Lawyers Sri Lanka (ACLSL) and In house Counsel Forum – Korea (IHCF). In 2011, APCCA was formally launched at the third such conference (organised by the IndonesiaCCA in Jakarta ) with the Malaysian Corporate Counsel Association (MCCA) and Legal Management Council of Philippines (LMCP) joining the alliance. APCCA partners SCCA, MCCA, IndonesiaCCA and LMCP are also part of the In-House Counsel Worldwide (ICW).

SPEAKER PROFILES

• He is an MBA, LL.M and also holds a Ph.D in Strategic Human Resource Management and currently pursuing Ph.D (Law) on Alternative Dispute Resolution Mechanism. He has authored numerous research papers/ articles published in various reputed journals.

• Has an overall experience of more than 36 years and is currently designated as Executive Director (Law & HR), heading Legal and HR Department of GAIL (India) Limited, a Maharatna Public Sector Undertaking under the administrative control of Ministry of Petroleum and Natural Gas. Currently also on the Board of GAIL Gas Limited, a wholly owned subsidiary of GAIL as Director (Non-Executive).

• He is an ardent negotiator and expert in strategizing and dealing with Trade Unions/ collectives for long term settlement, resolution of industrial disputes and also exhibits strong leadership to lead the cross functional team for settlement of commercial disputes through Conciliatory mechanism. He is known for pioneering in formulating several policies in the field of HR and Legal, which are being followed by the industry for system driven approach in resolution of many complex/ commercial issues.

• He is an Associate Member on the Governing Body of the Indian Council of Arbitration under the aegis of FICCI. He is also a Chairman of Legal Standing Committee (comprising of the legal heads of CPSEs) for legal matters and a Member of Steering Committee on RTI in SCOPE (Standing Conference of Public Enterprises). Also, currently member of the task force constituted by CII for advising judicial reforms in the country.

• Conferred Fellowship of NIPM (National Institute of Personnel Management) and also a key member of many progressive professional institutions like AIMA, SHRM, ISTD, National HRD Network, etc.

• He is one of the most sought after speakers in the areas of HR/ HRD initiatives, labour laws/ compliance issues. He is also a visiting faculty to many B-Schools and Law institutes/ Universities including IIMs.

• Has been featured twice in the top maiden General Counsel Power-list for India, published by Legal 500, a leading global legal directory (for the year 2016 and 2018). Also awarded ICCA’s excellence award for the year 2019. Also, featured in Trailblazers - a publication on country’s finest in-house counsels compiled by ICCA. 

Mr. Mohit Saraf heads the corporate practice of the Firm, including, Mergers & Acquisitions, Private Equity practices, Projects and Insolvency & Bankruptcy Law.

He has been recommended as one of ‘Asia’s top 25 M&A lawyers’; and is honored by ALB HOT 100 as one of the top performing lawyers. He is also a recipient of various national & international awards and has been consistently ranked as a ‘Band 1’ M&A lawyer in Who’s Who Business Lawyers, ‘Eminent Practitioner’ Chambers Asia Leading Lawyers, ‘Highly Regarded’ by IFLR 1000, ‘Leading individual’ by Legal 500, ‘Distinguished practitioner’ by Asialaw. He is also consistently ranked amongst ‘India's top 100 Lawyers’ by IBLJ A-list 2016- 2029.

Chambers & Partners describes him as “a dream lawyer for corporate transactions” because he balances the legal and commercial aspects of a transaction.

Mr. Saraf is a member of the National Executive Committee of FICCI and a Co-Chair of the following FICCI Committees – Private Equity & Venture Capital, Corporate Laws and the Stressed Assets.

Mr. Saraf has been awarded the ‘Shaurya Chakra’ (a national peacetime gallantry award by the Indian President, Mr. R. Venkatraman).

Dr. Ashok Sharma, a Fellow of CIArb (London), is now practicing as a Counsel and sitting as an arbitrator both in commercial and maritime arbitrations. He was General Counsel of MMTC Limited ( A Govt. of India Enterprise), India’s first Golden Super Star Trading House and leading International Trading Company having turnover of over Rs. 68,000 crores (over us $ 15 billlion) and having a subsidiary Company ‘MMTC Transnational Pte Ltd’. in Singapore.

Acted as a Consultant to the World Bank on an assignment on “Solutions and Innovations in Procurement “ in 2016-17.

Dr. Ashok Sharma, Chief General Manager (Law) MMTC Limited, was conferred the National Law Day Award 2008 for his `Outstanding Contribution to Practice of Law relating to Public Sector Undertakings' by the then Hon’ble Prime Minister, Dr. Manmohan Singh in Dec 2008.

Reza P. Topobroto started his legal career as a practice lawyer in 997, after moving to several law firms he had a chance promoted as a Senior Associate in Roosdiono & Partners.  In 2005, he shifted careers to corporate counsel by joining Procter & Gamble as Country Legal Lead. In 2008, Reza was appointed as the Head of Legal for Mondelez (p.k.a Kraft Foods).  In 2012 he joined Microsoft as Director of Corporate, External & Legal Affairs in charge for Indonesia.  After 7 years in Microsoft, he moved to Indosat Ooredoo in 2019, becoming Senior Legal Advisor to CEO. 

Reza was the third President of the Indonesian Corporate Counsel Association (ICCA). He ended his term in 2014 and continues contributions to ICCA through his role on the Supervisory Board. In 2009, he co-founded the Asia Pacific Corporate Counsel Alliance (APCCA), In 2012, he was appointed Secretary General of the APCCA. 

In 2015, Reza was given the award of ‘Indonesia In-House Lawyer of the Year 2015’ and ‘In-House Legal Team of the Year 2016’ by Asia Legal Business.   Reza obtained his law degree at Trisakti University, Jakarta in 1997, and his Master of Laws at Monash University, Melbourne in 2003. 

Anil a Mediator (accredited in South Asia), Arbitrator (Fellows of the Chartered, Singapore and Philippines Institutes of Arbitrators and Adjudicator (with AIAC Malaysia); and trained in International Treaty Arbitration, is an Advocate & Solicitor, Commissioner for Oaths and Notary Public of Singapore, a Solicitor of England and Wales (2009); qualified as Barrister Middle Temple of England & Wales (1993) and also holds a Master of Science in Construction Law & Arbitration, Kings College London & National University of Singapore (2006). 

In legal practice since 1995 and his Chambers representing parties in the region, focuses on Appropriate Dispute Resolution involving Infrastructure, Building, and Construction work and most aspects of Commercial, Civil, Criminal and Corporate Front End Advisory services. Conversant in Mandarin, Malay, Malayalam and Tamil besides English, he has also worked In House, with a International Arbitration practice and started his work life for five-years career as an infantry officer, Singapore Armed Forces. His consultancy also Consults & Administers International Infrastructure & Construction, Trade & Investment Treaty projects and developments; carries out Appropriate Dispute Resolution Services including Mediator, Adjudicator, Arbitrator, Dispute Boards, Expert Witness & Neutral Evaluator; and Developing Online Dispute Resolution Legal Technologies
