Singapore Corporate Counsel Association's Banking & Financial Services Chapter is pleased invite counsel in financial institutions to its annual data protection roundtable.
The session will begin with a data protection update by Baker McKenzie giving attendees an update about the data protection regime in Singapore, including a discussion of enforcement decisions of the Personal Data Protection Commission. We will also explore how legal teams are supporting and can better support Data Protection Officers in their work. Finally, the session will touch on data protection developments around the world that may affect persons based in Singapore. We will also query what impact, if any, a recent seminal Indian Supreme Court decision affecting the right to privacy is likely to have on common law jurisdictions like Singapore.
The session will then dovetail into a dialogue session with the Personal Data Protection Commission, where attendees may get some insights into its efforts for developing a trusted data ecosystem in Singapore and how that fits with the Prime Minister's ambitious Smart Nation initiative.

The fast-emerging Digital Economy is presenting challenges for consent-based approaches to personal data protection. Ubiquitous computing has changed the nature of data collection from active interaction to a passive one where devices seamlessly collect and transmit personal data across communications networks.
Increasingly, it may not always be possible to anticipate the purposes for using and disclosing personal data at the outset. Furthermore, where huge volumes of personal data involving large numbers of individuals are collected at high velocities and from a variety of sources, it may not be practical for organisations to seek individuals’ consent in every instance of data collection, or to attempt to identify the individuals to seek their consent for every new purpose.
Hence, PDPC proposes for consent to remain a key basis for collecting, using and disclosing personal data under the PDPA to provide individuals the right to exercise choice and control over their personal data.
Lastly, to strengthen protection for individuals and build confidence in organisations’ management and protection of personal data, PDPC is proposing to introduce a mandatory data breach notification to affected individuals.

This seminar will delve into the efforts made by the Singapore government to internationalize Singapore's dispute resolution offerings and in particular on the role to be played by the Singapore International Commercial Court (SICC) as a counterpart to the Singapore International Arbitration Centre (SIAC) (and the Singapore International Mediation Centre) in creating a hub jurisdiction. The SICC overcomes issues that have traditionally plagued arbitrations such as the ability to resolve disputes with third parties who have not consented to an arbitration agreement. Questions however remain as to the efficacy of the SICC since unlike awards rendered in Singapore-seated arbitrations, which may be enforced internationally via the New York Convention, the Hague Convention on Choice of Courts Agreements is of a far more limited scope.
The talk will explain what that scope is. The talk will then discuss the likelihood of other Asian countries such as China and Japan signing and ratifying the Hague Convention and will also discuss other Hague projects on the reciprocal enforcement of judgments that may overtake the Hague Convention which has seen active participation by China. Finally, the talk will focus on the recent Court of Appeal decision in Accent Delight v Bouvier and discuss how the existence of the SICC may affect the application of forum non conveniens principles in leading the Singapore to conclude whether Singapore is the appropriate forum to hear a dispute with international elements.

Singapore's Cyber Security Agency (CSA) released a draft Cybersecurity Bill on 10 July 2017, inviting the public to provide feedback on the proposed legislation as part of a public consultation exercise that will run until 3 August 2017.
