In recent years, concerns have been raised over increasing cost and length of arbitral proceedings. The right approach can increase efficiency and limit costs. This event will explore the nature of costs typically incurred by companies engaged in international arbitration proceedings and consider practical steps to minimize costs and assist with the recovery of costs. We will look into how arbitration allows companies to shift the financial burden of the proceedings to third parties, and appropriate alternative fee arrangements. Finally, we will propose case management techniques to reduce the overall costs of the proceedings. The sessions will be led by experienced in-house lawyers and their external counterparts and will focus on the real needs and concerns of companies.

In the oil and gas sector, we can’t run away from the implications of Sanctions imposed by the international bodies, eg. the United Nations, the United States of America and the European Union. Sanctions as a compliance issue came to the fore, especially in the oil and gas sector, when breaches of Sanctions could bring disastrous implications of prosecution by the relevant regulators.
In this seminar, we will look at how in the recent years, international political events giving rise to a proliferation of measures adopted by the United Nations and sovereign states, imposing trade restrictions, embargoes and other sanctions against delinquent governments and related entities and individuals. The result is a complicated, multi-layered regime of Sanctions with diverse political motivations and sometimes different scopes of application, which in turn means that the same transaction may be affected by different Sanctions. By their very nature, Sanctions have a direct impact on international trade. Taking a comparative law approach, this seminar will discuss the impact that Sanctions can have on day-to-day business contracts and their performance.

Since August 2012, legal advice privilege has been extended to communications with in-house legal counsel, with the introduction of section 128A of the Evidence Act.
In this seminar, we examine the developments in the law since section 128A of the Evidence Act was introduced *as well as overview of key judgments in certain jurisdictions on the area of in-house privilege. We will also explore key issues which arise in relation to legal advice privilege for in-house legal counsel, including the types of communications which are protected, and the various exceptions to privilege.
