Lex Mundi has compiled a guide of what constitutes attorney-client across over 65 different jurisdictions. Differences in the law among both common law and civil law jurisdictions can be significant. Companies and their counsel should be aware of these differences and how they may affect legal proceedings. We will host a panel discussion comprising experts from both civil and common law jurisdictions to share their experiences.

1. Background – brief (5 mins each panelist):
1. Basic law of attorney-client privilege/professional confidentiality
2. Basic law of Litigation Privilege or corollary in civil law jurisdictions
3. Include whether in-house counsel are within the privilege/professional confidentiality?

2. May the government – either criminal prosecutors or other regulators – override these privileges/confidentiality/protections?

3. Are there “legally trained” personnel who work for companies, but who are not attorneys/members of a bar of court?

4. How do privilege issues arise?
1. How do privilege/professional confidentiality/Litigation Privilege issues arise in your jurisdiction?
1. Regarding communications occurring and work product created in your jurisdiction?
2. Regarding communications occurring and work product created outside your jurisdiction?
2. How do these issues arise in other jurisdictions regarding communications occurring and work product created in your jurisdiction?
1. For example, how do you address demands in proceedings outside your jurisdiction for attorney-client communications and work product?

5. Best Practices:
1. How can house counsel maximize the protections of privilege/confidentiality?
2. What are the primary misconceptions that company personnel have regarding how privilege works? (In the U.S., the common misconception on the part of non-lawyers is that merely copying a lawyer on an email will make it privileged.)

6. Other issues & Q&A

WEBINAR: Domestic Violence: Is the Workplace Part of the Solution?

WEBINAR: Domestic Violence: Is the Workplace Part of the Solution?

Overview

As millions of people work from home, a new outbreak is growing - domestic violence. Prolonged periods of confinement coupled with the stress of financial uncertainty builds domestic tensions. The UNFPA expects domestic violence to increase globally by 20%. In Singapore, AWARE's Women's Helpline saw a significant surge in calls related to family violence.

At a time when the home has become the workplace, it has become clearer to employers that domestic violence impacts the workplace and is a workplace issue. The productivity of workers who experience domestic violence is severely reduced. Moreover, studies show that a high proportion of domestic violence victims confide in their managers and co-workers about the situation.

Progressive workplaces (including in Singapore) have started to implement domestic violence policies, provide benefits to support people who experience domestic violence, and to train their managers and employees to support their colleagues facing this issue. ILO Convention 190 calls on workplaces to take steps to counter domestic violence.

This panel will explore the role of workplaces in supporting its employees experiencing domestic violence, including the following questions:

a)      What is domestic violence and why is it a workplace issue?

b)      What kind of policies can employers implement to support their employees who are experiencing domestic violence?

c)      How can managers and co-workers be equipped to support their colleagues who are experiencing domestic violence?
