Tom Evrard is a Senior Managing Director in the Strategic Communications segment of FTI Consulting and is based in Singapore. Specialising in regulated industries, he has spent more than 17 years advising clients on complex corporate communications and reputation management events and long term campaigns. His areas of expertise include issues and crisis management, corporate brand development, public policy and litigation communications, media relations, and capital markets communications.  Tom brings a wealth of collaborative, cross-border experience to client engagements.

His most recent assignment is managing operations for the FTI Consulting Strategic Communications practice in Singapore where he is responsible for broadening the firm’s footprint throughout South East Asia.

Gino Bello is a Managing Director of FTI Consulting and leads the Technology segment in South East Asia, based in Singapore.  A computer forensics expert and certified computer examiner, Gino specialises in forensic collection, analysis and expert reporting of digital evidence.

Gino has over fourteen years of experience in Computer Forensics, Cyber, Legal Technology and IT.  Gino has led a broad range of matters including large scale, cross-border disputes, arbitrations and eDiscovery engagements in class actions and royal commissions.  He also assists clients in Cyber risk and incident response.  Gino has led investigations into IP theft, information leakage, anti-bribery and corruption, regulatory, and other employee-related misconduct.

Gino has extensive experience across a wide range of sectors, including construction, shipping, financial services, government, insurance, manufacturing, retail, health and utilities.

Arkrapol Pichedvanichok is a Senior Partner specializing in Corporate/M&A and Capital Markets Practices.  His experience includes joint ventures, mergers and acquisitions, foreign investment in Thailand, securities and exchange law, public company law, domestic and international equity capital markets transactions.  He has been involved in a number of strategic acquisitions and public takeovers in Thailand.  He had also taken a leading role in advising underwriters on the successful listing of many companies on the Stock Exchange of Thailand.

Arkrapol received his LL.B. from Chulalongkorn University in 1989; LL.M. from Boston University School of Law in 1991;  and LL.M. from Georgetown University Law Center in 1992.

He received his LL.B. in 1985, and LL.M. in 2003, from Ramkhamhaeng University.

He specializes in project finance, acquisition finance, general banking and M&A, with a focus on the renewable energy sector, in Thailand and across Southeast Asia. Many of the energy projects he has advised on have been awarded best in class, “Deal of the Year” recognition by international legal commentators. He acts for a variety of clients domestically and internationally, including sponsors, lenders and borrowers.

He is recognized as a Market-Leading Lawyer in Banking & Finance, Projects and Infrastructure from AsiaLaw 2019.

Event Overview

While the Belt & Road initiative is not a new development, recent legal innovations in China may give cause for corporate counsel to consider the attendant risks at play when transacting with Chinese corporates. Very recently, China has launched late last year a new International Commercial Court, and two commercial courts in Xian and Shenzhen to hear and resolve Belt & Road disputes. Corporate counsel from companies that have extensive transactions with China-based corporations ought to know about the hidden risks that could come with such transactions, especially now with these new Chinese courts at the background. Those risks are not limited to Belt & Road initiatives and can arise in other transactions with Chinese companies.

At this workshop, we will cover the emerging trends and developments that point towards key aspects to watch out for when involved in a Belt & Road transaction and similar transactions. We will explore with Corporate Counsel ways to mitigate the attendant risks at play including dispute prevention strategies, and project management techniques where Belt & Road and similar disputes do arise, including managing such disputes in efficient ways that would make full use of the tactical advantages that could be found in international dispute resolution frameworks. In this regard, there are important considerations around how Singapore as a strategic neutral seat could play a role in managing such risks.

Francis Goh

Francis heads the International Arbitration Practice Group. His practice includes all forms of dispute resolution covering arbitration, litigation and mediation.

He has more than twenty-five years of experience handling arbitration cases including areas of commercial contracts, infrastructure and construction disputes involving insurance claims, shipping claims and the associated applications to Court. He has acted as lead counsel in arbitrations under the SIAC, HKIAC, LMAA and ICC Rules. He has been retained by overseas corporations expanding into Singapore/Southeast Asia, local SMEs expanding beyond Singapore, as well as listed companies and MNCs as their legal advisor with a particular emphasis on legal processes to identify risks and manage disputes.

He also been approached by foreign counsels from UK, US, Canada, Norway, India, Indonesia, Australia, Taiwan and Kazakhstan to provide specialist views, advice and/or assistance on aspects of Singapore law, as well as provide expert testimony on Singapore law in foreign courts.

Francis is an accredited Principal Mediator with the Singapore Mediation Centre. Francis is a Fellow with the Singapore Institute of Arbitrators (SIArb) and is currently serving on their council as Honorary Secretary. He is also the Chairman of the SIArb Continuing Professional Development (CPD) Committee.

Shaun is an Of Counsel with the International Arbitration, Litigation and Dispute management group. Shaun served as a Magistrate and Registrar of the Supreme Court of Singapore for five years, where he decided matters in a wide range of complex cross-border commercial disputes. He was the Head of the Court of Appeal Section, and Secretariat of the Singapore International Commercial Court. After serving in the Courts, he practiced in major cross border disputes and international arbitration throughout the Asia Pacific Region with offshore magic circle firms for four years prior to joining the firm.

Shaun focuses on commercial disputes in common and civil law jurisdictions and provides representation and strategic advice for clients engaged in international commercial arbitration and dispute resolution at international commercial courts.

Shaun is an accredited International Arbitrator and Mediator of the Global Mediation and Conciliation Network.

Janice is a member of the firm’s International Arbitration team. She has handled international arbitration matters under the SIAC, ICC and HKIAC Rules, representing international and local clients in disputes involving commercial contracts, sale and purchase agreements, construction, and energy.

Prior to joining Eversheds Harry Elias, she worked with the Singapore International Arbitration Centre where, among others, she was responsible for the administration and management of arbitrations conducted under the SIAC Rules and the UNCITRAL Arbitration Rules.

Previously, she was an associate with a top-tier law firm in the Philippines where she specialised in commercial and public interest disputes. She has also clerked for the former Chief Justice of the Supreme Court of the Philippines. Janice is qualified to practice in the Philippines, the State of New York, and England & Wales.

K.T. Jung is the managing partner of Kim & Chang. He also serves as the Chair of the firm's Mergers & Acquisitions Practice and Antitrust & Competition Practice.

Mr. Jung practices in a wide ranging areas of corporate law with focus on mergers and acquisitions and antitrust/competition law. He has extensive experience in the corporate aspects of domestic and cross-border M&A transactions, including corporate restructurings, private equity transactions, and joint venture transactions. She also advises chemical and related industry clients including FMCG sector on regulatory issues that have been undergoing rapid change with focused enforcement activities.

Ms. Choi serves clients in a broad range of industries including pharmaceutical/medical device/food and cosmetic sectors. Specifically in the pharmaceutical regulatory area, she advises clients on pricing and reimbursement, compliance, bribery and competition law issues relating to promotional and marketing practices in the industry, anti-counterfeiting strategies, M&A, and restructuring of business operations.

Mr. Oh has represented corporate clients in a broad range of litigation, government investigation, and crisis management matters in Korea. In particular, he has advised many multinational companies in defending investigations by the Korea Fair Trade Commission for abuse of dominance, unfair trade practices, and other alleged regulatory violations. The Payment Services Act 2019 was passed in Parliament in January 2019. The new legislation consolidates the two current key legislations regulating various types of payment services into a single Act. The new Act also seeks to regulate new types of payment business models and expands the scope of regulated payment services.

The primer will provide an overview of the new consolidated payment services legislation and the business activities which it seeks to regulate. Participants will gain an understanding on the modular, activities-based licensing framework of the new legislation, and key business conduct and risk mitigation requirements which payment services business have to consider in navigating and complying with the new payment services regulatory landscape.

Event Overview

Bribery and corruption continues to be one of the highest-priority compliance risks for organisations, attracting considerable public media attention. The ISO37001 -  Anti-bribery Management Systems is a significant development for organisations seeking to better manage bribery and corruption risks. Singapore’s Corrupt Practices Investigation Bureau also adopted a local version of ISO37001, i.e. Singapore Standard ISO37001 providing organisations with a globally recognised benchmark for anti-bribery management systems.

Apart from large global organisations, some local companies in region (including Singapore) have taken the lead to become ISO37001 certified. EY’s Forensic practice has assisted companies in developing and implementing a prevention program and a culture of ethics, values and integrity in accordance with ISO37001. In this session, subject matter experts from EY will share critical learnings and some of the challenges clients face in their journey to either successfully implement or become certified with ISO37001.

Soufra follows the unlikely and wildly inspirational story of intrepid social entrepreneur, Mariam Shaar – a generational refugee who has spent her entire life in the Burj El Barajneh refugee camp just south of Beirut, Lebanon. The film follows Mariam as she sets out against all odds to change her fate by launching a successful catering company, “Soufra,” and then expand it into a food truck business with a diverse team of fellow refugee woman who now share this camp as their home.

Learn military techniques, war-games and personality strategies from experience women who have mastered the art

By being there for those who need a little more support, we can help change their future. At WILL 2019, SCCA is fortunate enough to be part of a project initiative by SG Enable where women with disabilities, young women at risk and women in law exchange life tips and share stories to make a difference in each other's life.

A Conversation About the Film SOUFRA - Q&A with Rebelhouse Asia Directors

Mr Suraj P. Upadhiah is the co-founder and Director of Rebelhouse Asia, a global social impact media agency that primarily produces and distributes documentaries for change. He is also the Chief Executive Officer of Air Amber, a social enterprise that is focused on community development through an Asset Based, Relational approach. Suraj is passionate about building uplifting relationships between people and communities that inspire positive action. He has traveled extensively, seeking adventure in learning from each relationship that he encounters.Suraj strongly believes that he has a part to play in co-creating a world filled with compassion, and not pity.

Tiziana Tan the Founder and CEO of Brain Juice Collective, the first youth-run marketing agency, education and venture ecosystem with a focus on elevating and empowering conscious brands to create global impact. By pioneering a hybrid model of dedicated consultants and a diverse youth talent network since 2015 and expanding into education and ventures a year later, they have meaningfully engaged more than 2000 youths as well as people with special needs and launched several successful start-ups including an online grocer and artist-driven range. She is also a Director at Rebelhouse Asia, a social impact film distribution and production house that has brought awareness, inspired action, changed laws and raised millions of dollars for impact. The group’s award-winning films have been featured at film festivals like Cannes and Sundance, on news media like The New York Times and Variety, distributed globally and bought over by the likes of Lionsgate (Pilgrim Studios), Netflix and more.

Her expertise lies in guiding senior leaders in what it takes to be a Transformational Leader and how best to prepare teams for the Future of Work. Carolyn has a strong track record of leading some of the largest digital transformation programs in Asia Pacific and is passionate about future-proofing companies for Industry 4.0+. As a senior professional and long term management consultant, Carolyn has performed roles such as Chief Digital Officer for a large South East Asian conglomerate (60 companies with 100,000 staff), as well as a KPMG Director in the Transformation practice. Carolyn is a Board Director for a Singaporean charity and is on the International Advisory Committee for the Australian Institute of Company Directors. Previously nominated for a National Teaching Award in Australia for Innovative Teaching, Carolyn also served on an Australian University Advisory Board for ten years. The Art of Charisma

Rachel Tan

Rachel Tan is an investigator of nearly 15 years and is professionally qualified as a Chartered Accountant (non-practicing; Institute of Singapore Chartered Accountants). She has exposure to a varied investigations portfolio, and has investigated employee misconduct, financial crimes (sanctions violations; money laundering etc.) and market misconduct (non-compliance with securities and derivatives regulations).

Her investigations career has taken her across the spectrum, from the private sector (varied industries, all MNCs), to a semi-regulator, and to a law enforcement agency. Some of her career highlights include being awarded by a major financial institution for her contributions to a task force, and her appointment as lead / joint investigator of high profile cases that have been the subject of global media interest.

In her current role as an investigator for a major Energy and Natural Resources MNC, she is based in Singapore and has regional (APAC) remit.

On this month's First Thursday, the SCCA is hosting a get-together at Soul Food, a social enterprise designed to empower persons with special needs. They have prepared for us a selection of canapes and wines to savour over the course of the evening and the founder of Soul Food, Gerald Png will share how his social enterprise benefits members of our community.

About Soul Food

SOUL FOOD ENTERPRISE PTE LTD – MADE BY MANY HANDS

Since its incorporation in January 2008, our mission has been to equip, employ and empower persons with special needs through our restaurant and food production business. To give them a platform to contribute to, and be included into mainstream society. 

With much plowing, sowing, encouragement and provision over the years by many hands, we have progressed from being a struggling social enterprise to become an emerging, sustainable food business whose products are made and served by the many hands of our dedicated team. We also aim to showcase our team’s abilities, potential and viability to other F&B businesses, corporations and individuals that may encourage them to “hand” them an employment opportunity and include them as we do.

 

EQUIP

Much time is extended to our staff team; for them to learn specific kitchen skills, food preparation and customer service in a highly commercial environment. And with the benefit of more time to learn, they acquire the confidence and competence to perform many tasks. We have been privileged by the opportunity to learn from them even as we train, supervise and work alongside them.

 

EMPLOY

Employment-ready persons will be assigned to assist in the production and service of our home-style modern European cuisine. As our motto goes “Made by Many Hands” – every team member has a hand in the preparation of our home-style delicious soups, salads, sauces, desserts, appetizers and main courses. According to their readiness and skill levels, they are involved in the various stages of production and aspects of the business. They are our main workforce working alongside and guided by our leaders and coaches.

 

EMPOWER

Besides training and employment, we endeavor to build a community where they may foster wholesome friendships and camaraderie; an inclusive environment for them to work and relate with typical colleagues and volunteers.

In their time at Soul Food, we hope that they will experience success as they are equipped, employed and empowered. We aspire for them to have self-esteem and confidence as well as a heightened degree of independence. That they may fully integrate as dignified, capable and contributing citizens in Singapore.                                                  

Soul Food is a registered member of The Singapore Centre For Social Enterprise. We have tie-ups with SG Enable Ltd through the Open Door Program and the SG Enable Training Grant.
